A BALCONY. MEREDITH: HERE’S THE GOOD NEWS. The dog is fine. WESH 2’S CLAIRE METZ REPORTS THAT THE ENTIRE INCIDENT HAS BEEN RECORDED IN THE CHIMNEY OF SHERIFF BECAUSE POSITIONS ARE ALREADY ON SITE AFTER RECEIVING A CALL THAT THE SUSPECT HAS BEEN IDENTIFIED. >> SHERIFF’S OFFICE. CLAIRE: DEPUTIES WERE CALLED TO THIS MOTEL 6 ON WEST SPEEDWAY BOULEVARD BECAUSE AN EMPLOYEE ATTACKED AN EMPLOYEE AND THEN JUMPED THROUGH THE BALCONY ON THE SECOND FLOOR. Allison Murphy, 35, was back in her room by the time investigators arrived. She eventually opened the door and stepped out with a 40-pound German Shepherd that she suddenly picked up. >> NO! WHAT ARE YOU – STOP FIGHTING OR I WILL CUT YOU. >> YOU CAN’T KILL DOGS? CLAIRE: THAT’S THAT DOG, A FEMALE RESCUEER, NAMED MIRACLE, FOR IMPROPER REASONS. MIRACLE REALLY LANDS ON YOUR FEET, WALKING TO THE BUSY ROAD WITH YOUR LEASH STILL ATTACHED. >> I said let me get the dog before he goes on the freeway. CLAIRE: JOSE CARNOT OPERATED HIS FOOD CART NEARBY AND GRABBED the frightened Shepherd and took them back to the hotel and enforce the law. DEPUTIES SAY MIRACLES SURVIVED THE CASE WITHOUT INJURY, despite doctors finding a sewing needle in her thigh and removing it. Meanwhile, the suspect was handcuffed and charged after allegedly defying resistance. Those first answers are baffled by the violent attack on a year-old miracle. >> We all thought she was about to grab the dog and probably bring him back inside, but she – right over the railing, she just tossed him over the rails. CLAIRE: SUSPECT MURPHIE HAS BEEN ASSIGNED TO MAKE A FIRST APPEARANCE IN FIRST PRISON. JURPHY refused to come out, however. THE JUDGE ORDERED TO KEEP SHE TEMPORARILY DISCONNECTED WHILE SHE SEARCHING FOR HEALTH QUESTIONS. IF NONE ARE FOUND, BOND IS SET AT $ 10,000. IN VOLUSIA COUNTY, CLAIRE

A judge granted Volusia County custody of a dog that was tossed over a motel balcony in December. The body camera video captured the moment officials said the German shepherd’s owner, Allison Murphy, threw the dog off a second-floor motel balcony in Daytona Beach. During a January custody hearing, Murphy said she had suffered from mental health problems and that she would never intentionally harm her dog. A judge ruled that Murphy either unable or unable to take care of the dog, nicknamed Miracle. Miracle, a trained service dog, is placed with a veteran in need. Animal cruelty charges are pending against Murphy.
